Na své jmenování čeká nyní nejméně pět desítek soudců. Do konce roku by je měl jmenovat prezident Miloš Zeman. Pokud by se jmenování nestihlo, mohlo by hrozit plynulost projednávání kauz. Na tiskové konferenci po skončení 31. sněmu Soudcovské unie ČR to řekl její prezident Libor Vávra.
„Do konce letošního roku by mělo být jmenováno minimálně 50 soudců obecných soudů, kteří už teď chybí. Samozřejmě nemoc prezidenta v tom hraje jistou roli, nicméně existují možnosti, jak i za této situace jmenování uskutečnit. Apelovali jsme na ministerstvo spravedlnosti, aby se pokusilo situaci vyřešit,“ uvedl Vávra. Dodal, že pokud na menších soudech schází jeden či dva soudci, má to značný dopad na řešení běžných případů.
Kdyby se jmenování do konce roku nestihlo, museli by soudci nejspíš znovu procházet výběrem. Pravidla od ledna mění novela o soudech a soudcích, která upravuje vybírání kandidátů. Podle Vávry se nestíhají připravit doprovodné předpisy, takže navíc hrozí, že po Novém roce nebude možné nové soudce vybírat. „Kdyby se tyto dvě věci sešly, tak pochopitelně to může významným způsobem ovlivnit plynulost výkonu spravedlnosti na území ČR,“ dodal šéf unie.
Prezident Miloš Zeman je od 10. října v Ústřední vojenské nemocnici (ÚVN). Podle vyjádření, které nemocnice poskytla v pondělí Senátu, není nyní hlava státu ze zdravotních důvodů schopna vykonávat žádné pracovní povinnosti a dlouhodobá prognóza je krajně nejistá. Politici proto začali řešit možný přesun prezidentských pravomocí na premiéra a předsedu Sněmovny podle článku 66 Ústavy. V pátek ÚVN informovala o mírném zlepšení prezidentova stavu díky léčbě.
Dva dny po převozu do nemocnice Zemanův mluvčí oznámil, že prezident jmenoval soudce brněnského krajského soudu. Vyvolalo to pochybnosti. Poté Hrad upřesnil, že jmenování hlava státu podepsala ještě před svou hospitalizací.
Podle Vávry není jasné, jak daleko je vyřizování jmenovacích dekretů pěti desítek soudců. „Varianty jmenování jsou hodně pestré Významně se budou odvíjet od kondice pana prezidenta. Asi není těžký akt, aby podepsal padesát jmenovacích dekretů, když už byl předtím s návrhy seznámen,“ uvedl Vávra. Při případném převzetí prezidentských pravomocí je pak možné, aby soudce jmenovali jiní ústavní činitelé.
Unie jednala na sněmu také o elektronizaci v justici. Podle Vávry mají soudy řadu různých programů, spisy a další materiály tak nemohou sdílet. Potíže jsou i s plánovaným zveřejňováním anonymizovaných rozsudků. Anonymizér mají k dispozici okresní soudy, ale ne krajské a vyšší soudy, podotkl Vávra.
Na svém sněmu čeští soudci podpořili také své polské kolegy. Ocenili obě polské soudcovské unie za odvážnou obranu soudcovské nezávislosti i snahy udržet vládu práva. Do Prahy dorazili i šéfové soudcovských unií z okolních států a ze zemí EU či z USA. Debatovali o možnostech evropského a mezinárodního práva.
